HOA Attorney Correspondence
The following statements are taken directly from correspondence provided by legal counsel representing the Tahoe Village HOA Board in response to requests to modify snow placement practices near residential structures.
Continued Snow Placement
“There are no alternative locations to place snow, and the HOA will continue to place snow there as needed.”
The HOA confirmed that snow placement in this area would continue.
Established Snow Storage Practice
“The Association and its contractors… have consistently done so over at least the last 30 years, probably longer.”
This indicates the practice is longstanding and ongoing.
Response to Request for Change
“The Tahoe Village Homeowners Association rejects your demand that it cease using its common area… for snow storage.”
The request to modify snow placement practices was formally declined.
Summary of Position
Based on the correspondence:
-
Snow placement in this area is intentional
-
The practice has been ongoing for decades
-
Requests to change the practice have been declined
Context of Conditions
Snow in this area has been observed to accumulate well beyond natural snowfall levels due to mechanical placement from roadways and parking areas.
Communication and Engagement
To date, no member of the Tahoe Village HOA Board has contacted me directly to discuss the conditions at 331 Quaking Aspen or 339 Tramway Drive.
No Board member has met with me on-site at either property to review the conditions or discuss potential solutions.
