Tahoe Village Board Response Letters from Attorney (Not one time in 3 years of bringing attention to these issues has any TVHOA Board Member reached out to me by phone, email and/or met with me in person to walk the site and review the situation).
Tahoe Village HOA pushes snow down the hill on the south, west, and north sides of the 331 Quaking Aspen building.
Attached are letters the HOA Board directed counsel to write in response to my repeated requests—over a 3-year period—to stop piling snow around and against my building. On the north side, the HOA stacks more than 10 feet of snow directly on top of the water mains. If water ever needed to be shut off at the mains, we would first have to dig through 10 feet of snow.
The snow dumped down the west side of the building undermines the post-and-beam foundation. Over the years, the HOA has had to make multiple repairs to my decks and stairs—repairs directly tied to snow piled against the decks and building. I have repeatedly documented in writing that their practices are causing ongoing damage.
There are two key takeaways from the HOA’s letters:
1. TVHOA Board's position that they are not going to stop piling snow in this area. "There are no alternative locations to place snow, and the HOA will continue to place snow there as needed."
2. The TVHOA Board makes it perfectly clear they have been piling snow down this hill in this specific area for many years "The Association and its contractors use the common area for snow storage and have consistently done so over at least the last 30 years, probably longer."
"Given the foregoing, the Tahoe Village Homeowners Association rejects your demand that it cease using its common area surrounding 331 Quaking Aspen for snow storage. The Association is permitted to use its property for any lawful purpose."
